Trademark monitoring

Your registration doesn’t watch itself.

The USPTO doesn’t tell you when someone files a name close to yours, and nobody tells you when a copycat shows up online.

Monitoring is how you find out while it’s still easy to stop. Watch covers one registered name. Orchard covers a brand with more than one mark.

Why timing matters

Early is cheap. Late is expensive.

The same conflict costs very different amounts depending on when you catch it.

  • Before it’s approved

If a similar application is still being examined, a letter of protest can point the examiner to your registration. It is a short filing with its own USPTO fee.

  • After it’s published

Once a mark is published, stopping it takes an opposition at the Trademark Trial and Appeal Board, which we don’t handle. Catching it before that point is the reason to watch.

  • Out in the world

Copycats online usually stop with a cease and desist letter or a marketplace complaint, if you act before they build a following.

  • Your own deadlines

A declaration of use is due between years five and six, and a renewal every ten years. Missing one cancels the registration.

Questions

Monitoring questions

Doesn’t the USPTO protect my registration?

It checks new applications against existing marks, but it can approve a name you’d consider too close, and it never polices use online. Enforcement is up to you.

What do I do when the report finds something?

We tell you whether it’s worth acting on and what the options are, from doing nothing to a letter. Acting is always your call.

Do I need monitoring if my name is unusual?

Unusual names are the ones most worth protecting, and copies of them are easier to spot.

Can you monitor a mark you didn’t register?

Yes. Any live federal registration or pending application can be watched.
